4. Defenses to Prescribing a Controlled Substance without a Legitimate Purpose
As described above, a doctor who acts in good faith in writing a prescription for a controlled substance would not be criminally liable for this offense. This defense would apply even in instances where the doctor may have acted negligently or where the doctor’s practice is different from other medical professionals.
